Durban City ineligibility saga: 'It's quite simple'

With Durban City's promotion to the Betway Premiership yet to be confirmed by the PSL due to the alleged ineligibility saga, KickOff has insight on registration rules.

City finished the Motsepe Foundation Championship season at the summit by five points, following a 1-0 win over Cape Town Spurs, who were relegated, on the final matchday on Sunday.

However, the League had already revealed that the trophy handover would not be taking place, after a protest by JDR Stars that the Team of Choice fielded Saziso Magawana improperly throughout the season.

Magawana signed ahead of 2024/25 from Leruma United, who had just bought the status of Marumo Gallants, with the latter having purchased the Premiership franchise of Moroka Swallows.

According to reports, JDR, in their protest, allege the former Golden Arrows winger received his clearance from a wrong club and should have been cleared by Leruma, not Gallants.

This publication spoke to an experienced transfer expert in South Africa, to get insight on registration rules.

"Gallants are no more, so he (Magawana) goes to Durban City, he did the correct thing and asked Gallants for the clearance, Gallants cleared him. That was his last month," said the stakeholder.

"Leruma can't clear a player who has not played for them or registered for them. It's quite simple. You can't be cleared by a club you never played for.

"Just because Leruma bought Gallants, it only means they're responsible to pay everything (owed to players) and to keep the players they have to renegotiate. Until Leruma have a new contract with him, why should Leruma clear him?" quizzed the official.

"If Leruma wanted the players from Gallants, they have to agree on a new contract. They're only responsible for outstanding fees from the previous contracts that were under Gallants.

"If he agreed a new contract with Leruma and played, Leruma would then have to clear him because he played for them. There shouldn't be a protest. Even if Leruma bought Gallants, it doesn't give them the God-given right to all the players.

"You can't play for Gallants and months later play for Leruma with the same contract and same registration. You have a contract in the name of Gallants and Gallants is no more. If the player does not agree to a new contract, he doesn't have to," the source added.

The PSL Dispute Resolution Chamber (DRC) will hear the matter on Tuesday.
